記者從四川省高級人民法院獲悉，近日，眉山市彭山區法院審理判決了一起通過自制虛假的虛擬幣交易平台實施詐騙的案件，胡某和楊某纖等7名被告人分別被以詐騙罪和掩飾、隱瞞犯罪所得罪判處有期徒刑十二年六個月至有期徒刑二年十個月，緩刑三年，並處罰金。

2020年3月至2020年12月，胡某與楊某纖等人利用注冊的成都嘉榮騰軟件信息科技有限公司（以下簡稱嘉榮騰公司），通過非法經營“盛大合約”虛假的虛擬幣投資平台，以“保本理財、爆倉保本”誘騙客戶購買泰達幣（一種虛擬幣）后兌換平台專有的虛假虛擬貨幣PTC，再通過PTC在平台購買比特幣等虛擬幣實現盈虧。

受害人張某某，2020年4月應聘到嘉榮騰公司上班，一直到當年12月案發。入職時，楊某纖向其謊稱公司總部在新加坡，由新加坡基金會投資，受新加坡MAS金融局監管，擁有美國區塊鏈金融監管局MSB牌照，平台上運營的虛擬幣PTC國際通用。

2020年12月15日平台賬戶出現自動爆倉，所有賬戶被清零。平台發出公告解釋，由於被黑客攻擊，裡面的資金全部虧損完了。胡某解釋說平台會出一些補救措施，之后會賠償全部損失給投資人。楊某纖強調如果還有警察來調查，就隱瞞員工做平台推廣的事情。之后楊某纖卻把參與投資的員工微信全部拉黑。2020年4月底至12月，張某某共向平台投入本金80多萬元，獲得返利11萬余元，共被騙60萬余元。

被害人晏某和楊某纖是大學同學。2020年3月底，楊某纖向晏某介紹他們公司代理一款叫“盛大合約”的虛擬幣投資APP，有保本協議。晏某認為自己跟楊某纖是同學，應該不會被騙，於是多次投資。

2020年12月18日，盛大合約APP發出公告，要求所有客戶重新充值后，才有機會找回之前被黑客攻擊丟失的資金余額，晏某便多次找楊某纖退錢，卻被楊某纖拉黑了微信。2021年1月，晏某和其他投資人在成都報警。據介紹，2020年3月底至12月，晏某共在盛大合約投入41萬余元，獲得返利16萬余元，共被騙24萬余元。

2020年5月，受害人胡某某看到微信好友林某在朋友圈推廣一個投資理財APP，宣傳“保本理財、爆倉必賠”。2020年6月，胡某某懷著試一試的想法，用手機和身份証、銀行卡注冊賬號，投資人民幣3.6萬余元。隨后，林某把其拉進盛大合約VIP微信群，群裡有300多人，每天都有人晒投資金額及收益，楊某纖也經常發截圖晒新會員入金多少，還晒出自己買的保時捷跑車。

法官提醒，虛擬幣不是貨幣發行機關發行的，並不具備貨幣屬性，不具有與貨幣同等的法律地位，虛擬幣的交易或投資不受法律保護。許多不法分子正是利用了投資人想通過炒幣“一夜暴富”的心理，打著虛擬貨幣的幌子實施詐騙犯罪。投資理財要選擇正規的渠道和平台，切莫貪圖所謂的高額回報，也沒有“穩賺不賠”的投資理財，否則容易落入犯罪分子的圈套。（華西都市報-封面新聞記者 戴竺芯）
