Whether Bitcoin is legal or not has been the subject of controversy. On the one hand, Bitcoin is not a legal currency worldwide, so that its sale is considered to be an illegal transaction; on the other hand, Bitcoin transactions have been in existence for many years and have more practical applications and are therefore considered to be a legitimate asset deal.
The legal status of Bitcoin is not clearly defined worldwide. In some countries, bitcoin is considered legal, such as Japan and Australia, while in others, bitcoin is considered illegal, such as Brazil and Bangladesh.
In China, the legal status of Bitcoin has also been a constant concern. In December 2013, seven ministries, including the People’s Bank of China, jointly issued a Notice on Protection against Bitcoin Risk. The Circular states that Bitcoin is not a currency and is not considered a legal currency and cannot be used as a currency in the market.
It should be noted that, while financial institutions are prohibited from providing Bitcoin services, China does not prohibit transactions between individuals in bitcoin. Thus, the sale of bitcoin by individuals does not constitute a violation of the law. However, the law does not fully recognize the legality of bitcoin, so that when doing so, individuals are required to comply with the relevant laws and regulations in order to avoid risks.
The following legal risks may arise in the course of the individual purchase and sale of bitcoin:
1. The legal status is unclear: because the legal status of Bitcoin is unclear, it is difficult to obtain clear support for the legal problems faced by individuals when buying and selling bitcoin.
2. Regulatory risk: Although it is not illegal for individuals to buy and sell Bitcoin, regulatory agencies may still take a number of restrictive actions for risk prevention. For example, Chinese regulatory agencies may take measures to block the Bitcoin exchange or adopt stricter regulatory policies in Bitcoin.
3. Insufficient risk profile: Many people do not have sufficient risk profile when buying and selling Bitcoin. For example, failure to provide adequate knowledge and analysis prior to making a transaction, or failure to protect personal privacy and security of assets, increases the risk that individuals incur during a transaction.
In order to avoid the legal risks arising from the purchase and sale of bitcoin by individuals, the following points need to be noted:
1. Fully understand and analyse the risks, trends and prospects of the Bitcoin market in order to secure its own investments.
2. Select a secure and reliable Bitcoin exchange for trading.
3. To protect the privacy of individuals and the security of their assets from theft, fraud, etc.
4. To comply with the relevant laws and regulations and to take control of regulatory policies in order to avoid legal risks arising from violations of the law.
Although the legal status of Bitcoin has not been confirmed, its mode of dealing has been in place for many years. In China, the buying and selling of bitcoin by individuals does not constitute an offence, but attention needs to be paid to changing unpredictable policies and regulations in order to avoid risks arising from legal issues.
